Abingdon Auto Auction Arbitration Policy

Abingdon Auto Auction follows the latest edition of the NAAA Arbitration Standard Policies except (and in addition to) the following:

Lights

 
Green Light / Ride and Drive: The green light signals that this vehicle is guaranteed under the conditions outlined in this policy. Any defects or issues requiring disclosure per this policy should be announced.
 
Red Light / As-Is: Vehicles announced AS IS or selling under $2500.00 cannot be arbitrated except for title brands, mileage problems and structural integrity. Any vehicle 20 years and older will be sold AS IS—NO ARBITRATION.

Reports and Titles

 
  • Structural damage on a Green Light vehicle must be reported to the auction within 7 days of the sale date. Sale day is day one.
  • Flood damage must be reported to the auction within 7 days of the sale date. Sale day is day one.
  • Voided factory warranty must be reported to the auction within 7 days of the sale date. Sale day is day one.
  • Not actual miles must be reported to the auction within 7 days of the sale date. Sale day is day one.
  • Titles must be present at the auction within 30 working days of the sale date on any vehicle sold TA.
  • Rebuilt/Salvage title must be announced.
 
All titles submitted by Seller must be in Seller's company name on title or on a properly executed reassignment form. The Seller guarantees the titles of vehicles that are sold through Auction. This guarantee of the title warrants that the title shall be marketable and free and clear of all liens and encumbrances. This includes any brand (such as "salvage") noted upon the current or any prior certificate of title unless such encumbrances were announced at the time the vehicle is sold through Auction and for a period of four (4) years from the date of sale. Seller's liability under this title guarantee shall never exceed the Auction sale price (the "maximum amount") of the vehicle, and this maximum amount shall be reduced by two percent (2%) per month following Auction sale date. All liability under this title guarantee shall expire and terminate four (4) years after Auction sale date. Auction will not be responsible for any expenses incurred on vehicles returned for late title.
 

Announcements

Green Light on vehicles sold 125,000 miles and under guaranty, any defect that costs over $800.00 to repair must be announced for any of the following items:
  • Engine
  • Transmission
  • Rear end and driveline
  • Rack and pinion (over $800.00 to repair must be announced)
  • 4X4 (must work on sale day)
  • AC (must work on sale day)
  • Check engine light, ABS light, and SRS light if over $800.00 to repair
  • Emissions equipment problems
  • Electrical accessories (power windows, sunroof, radio, etc.) on current-year models and models up to 4 years old
  • Hybrid or any other electric vehicle battery problems

Other Issues

  • Fuel conversion vehicles must be announced
  • Vehicles not equipped with factory AC must be announced if under 10 years old
  • Non-original engine must be announced (with the exception of warranty replacement) on any current-year model and models up to 4 years old
  • Structure damage must be announced
  • Voided factory warranty must be announced
  • Flood damage must be announced
  • Theft recovery must be announced
  • Mileage problems / Inop odometer must be announced
  • Total loss history must be announced
  • Biohazard vehicles must be announced
  • Previous Canadian vehicles must be announced
  • Wear items such as but not limited to: suspension items, belts, hoses, timing belts, brakes cannot be arbitrated (unless unsafe to drive)
  • Clutch/Manual Transmissions: Vehicles with full or partial shift transmissions cannot be arbitrated for manual clutch assemblies unless the defect will not allow a safe test drive. This includes a bad flywheel, throw out bearing, slave cylinder or any related parts to the clutch assembly.
  • Logo or decal misrepresentation may be arbitrated
  • Any vehicle sold Green Light and deemed unsafe to drive by the Auction can be arbitrated
  • If unit is purchased online, buyer has 7 calendar days to arbitrate. Sale day is day one.
  • Vehicles with more than 300 miles may not be accepted for arbitration. Vehicles must be in the same physical and mechanical condition when returned.
     

Vehicles over 125,000 miles sold Green Light guaranty the following items only:

  • Engine
  • Transmission
  • Rear end and driveline
  • 4x4 (must work on sale day)
  • Structure damage
  • Flood damage
  • Mileage problems
 
The Auction holds the right to void any sale for any reason.
 In-lane arbitration ends at 4:00 PM on sale day.
